THE GOVERNMENT OF RUSSIA CONSIDERS NEW STRICT RULES REGARDING USE OF “FARM PRODUCT” DESIGNATION

In May 2023, the office of Vice-Premier Victoria Abramchenko (responsible for agricultural policy) announced that the government was considering a new draft law to define the term " farm product" in order to prevent possible misleading of consumers by unfair food producers.

In Russia (as in many other countries) there are special rules for using the term "organic food", i.e. special requirements for "organic" products are established by the Federal Law "On Organic Products" on 03 August 2018. However, due to historical reasons and marketing activities of local agricultural enterprises, most consumers consider “farm product" as another name for "organic product".

Currently, the use of "farm product" designation is not regulated and there are many trademarks with the word "farm" (however, "farm" could only be used as an unprotected element). As a result, "farmer's burgers" could be produced by a large industrial meat processing plant, and they could "justify" the use of the word "farm" by including a disclaimer about "meat supplied by farmers". The "farmers" referred to could be a large industrial livestock complex, rather than the small rustic farm that the average consumer might imagine.

Given that the government is aware of the problem, we should expect to see changes in the law in the foreseeable future to close such a gap in unfair marketing. This also means that FMCG companies would have to change their approach to new product names and trademarks accordingly.
