A SEMINAR ON THE LATEST LEGISLATIVE DEVELOPMENTS IN CHINA’S PATENT LAW

On 12 June, 2024, the EPO, together with CNIPA and IP Key China, organised a seminar on the latest legislative developments in the Chinese patent landscape. The online event was attended by a wide range of patent professionals, policymakers, industry leaders, examiners, young experts, and students. The seminar provided a comprehensive overview of recent amendments in Chinese patent law and outlined the implications for global IP strategy.

Christoph Ernst, Vice President of the Legal and International Affairs Department of the EPO, gave a keynote speech during the event. In his speech, he spoke about the role of intellectual property in addressing new problems and opportunities arising from rapid technological change, such as artificial intelligence, biotechnology, and green energy. He also highlighted the importance of a shared vision among the IP Agencies and outlined future cooperation with CNIPA. CNIPA Director General Qian Mengshan highlighted the importance of the EPO as a strategic partner for CNIPA and the success of their long-standing cooperation.

During the event, the attendees were also briefed on several important developments and initiatives. CNIPA experts gave a detailed presentation on the latest amendments. These amendments aim to strengthen patent protection, improve the quality and efficiency of patent prosecution, and promote innovation.

The EPO-CNIPA International Search Authority (ISA) pilot project, which has been extended until December 2026, will help China-based inventors to secure protection for their inventions in Europe. The success of this initiative is evident, with 440 Chinese companies actively participating and benefiting from it.

The seminar highlighted the value of ongoing dialogue and international cooperation between patent offices and stakeholders. As the global patent landscape evolves, such events play an important role in promoting mutual understanding and cooperation.
