RECIPROCAL ENFORCEMENT OF JUDGMENTS: MAINLAND CHINA AND HONG KONG'S INTELLECTUAL PROPERTY AGREEMENT

A significant agreement signed in 2019 between Mainland China and Hong Kong for reciprocal enforcement of judgments came into force on January 29, 2024, marking a significant milestone in judicial cooperation between Mainland China and Hong Kong. The Mainland Judgments in Civil and Commercial Matters (Reciprocal Enforcement) Ordinance broadens the scope of applicable judgments, including those related to intellectual property rights. This development allows for easier enforcement across borders without initiating new legal proceedings. Starting from January 29, 2024, any Mainland Judgment issued can be enforced in Hong Kong. Key points include coverage of various intellectual property rights and specified judgments, simplified enforcement procedures, and greater flexibility in choosing legal forums.
