Update: Fast Track Option to Gain Benefits For New Filing and Renewal of Trademarks in Thailand

The Thai Department of Intellectual Property (DIP) recently issued Notifications on Fast Track examinations for new trademark filings named, “First Action Fast Track”, and for trademark renewals named, “Fast Track”. These Notifications are part of the DIP’s ongoing effort to elevate and facilitate the DIP’s services for the benefit of trademark applicants and trademark registrants. These positive steps reflect the importance the DIP and the Thai Government place on trademarks and the positive contributions trademarks make to Thai commerce and Thai society.
The key points for the Fast Track processes include the following:
NEW FILING
The First Action Fast Track will accelerate the examination process for straightforward trademark applications, enabling applicants to receive their first Office Action, such as publication order, trademark amendment request, or trademark rejection, within six (6) months, instead of the usual 12-18 months.
The elements necessary to use the First Action Fast Track are:
1. Total number of goods/services covered by the trademark application must not exceed 10 items.
2. Goods/services must be identical to the recommended list of goods/services provided by the DIP on their website.
3. No amendment, assignment, or additional evidence to prove trademark distinctiveness has been made to the filing application after filing date.
4. Trademark application must be submitted by the trademark owners or its authorized representative at the DIP, E-filing system, provincial commercial office, or by post.
NOTE: If any filing application meets the above DIP requirements, it will be automatically examined under the Fast-Track process. No request must be filed.
RENEWAL
This Fast Track trademark renewal process will shorten the time it takes to receive an original certificate of trademark renewal, from sixty (60) days to only 60 minutes once a renewal is filed. The following criteria must be met to acquire this advantage:
1. Total number of goods/services covered by trademark must not exceed 30 items regardless of the number of classifications in the application.
2. The information for trademark registration remains unchanged.
3. Renewal application must be submitted at the DIP by the trademark owner or its authorized representative. E-Filing system is not allowed.
4. A request to obtain the Fast Track benefit must be made to the receiving officer.
5. Full renewal payment must be made.
