VIETNAM ESTABLISHES SPECIALIZED INTELLECTUAL PROPERTY COURT

Vietnam's National Assembly recently passed an amendment to the Law on the Organization of People's Courts (LOPC) on June 24th, 2024, paving the way for a significant development – the establishment of a specialized Intellectual Property Court. This move reflects Vietnam's commitment to enhancing IP protection and enforcement, aligning with the country's growing economy.

Under the current legal framework, Vietnamese Courts handle a wide range of cases, making it difficult to provide judges with specialized training on complex topics like IP law. The newly revised Law establishes a specialized court within the Vietnamese judicial system to address this challenge. This court will handle IP disputes at the first-instance level. Regarding the court's structure and implementation, it will consist of specialized judges, inspectors, clerks, and other staff. According to the latest draft of the Law, the IP Court will be located in Hanoi, Da Nang, and Ho Chi Minh City.
