New IP Filing Forms in Hong Kong to Take Effect in May 2025

Starting May 16, 2025, Hong Kong's Intellectual Property Department (IPD) will introduce new forms for trademarks, patents, and designs. A key change is the requirement for agents to declare their physical presence in Hong Kong. This aims to ensure the accuracy of the information provided, as submitting false declarations or misleading statements will be considered a legal offense.

This update addresses concerns about foreign agents filing on behalf of clients without being physically located in Hong Kong. These arrangements have sometimes caused communication delays, missed deadlines, and confusion, especially in contentious IP matters. Additionally, foreign agents may not be familiar with local laws, which can lead to suboptimal advice and unnecessary costs for stakeholders who may need to refile.
