Cambodia Launches Trial of Intellectual Property Rights Recordation System (IPRRS)

On September 16, 2024, the Cambodia General Department of Customs and Excise launched a trial phase of its Intellectual Property Rights Recordation System (IPRRS). This initiative marks a significant advancement in enhancing the protection, enforcement, and management of IP matters in Cambodia.
For the first time, intellectual property owners will be able to record their intellectual property with Cambodia Customs. The recorded IP will then be shared with Customs offices across Cambodia, facilitating the identification of counterfeit goods. This, in turn, will assist IP owners in working with Customs to confiscate counterfeits.
Who can request Customs IPRRS?
• IP owners - Required information: company name, date of registration, registration number and authority, and contact information.
• Exclusive Distributors - Required information: company name, date of registration, registration number and authority, contact information, number, and date of exclusive distributorship notice from the Ministry of Commerce.
Required documents to record intellectual property rights with Customs:
• Original signed and notarized Power of Attorney.
• IP certificates.
• Incorporation certificates.
• Pictures or Videos of trademarks.
• Pictures or Videos of the products for identification (genuine and counterfeit).
• Other documents requested by officials.
Required documents to record an exclusive distributorship right with Customs:
• Original signed and notarized Power of Attorneys.
• Certificates of recordal of exclusive distributorship.
• Exclusive rights letters of the brand owner.
• Incorporation certificates and IP Certificates.
• Pictures or Videos trademarks;
• Pictures or Videos of the products for identification (genuine and counterfeit);
• Other documents shall be requested by the officials.
Term of Validity and Recordation Timeframe
• Recordation under the IPRRS will remain valid for the term of the IP rights.
• Upon renewal of a trademark registration or exclusive rights distributorship, a new recordation under the IPRRS is necessary.
• There will be no official notice or certificate confirming recordation under the IPRRS.

The Customs IPRRS is available via the GDCE’s website - https://lnkd.in/gMEXN87F . Applicants will require an authorized user account.
IP owners can also request to apply in accordance with the procedures in force to suspend the completion of customs clearance procedures for any export-import goods that are found to be infringing on intellectual property.

• The details of the products for identification (genuine and counterfeit) including sample products.
• Evidence of the products.
• Original signed and notarized Power of Attorney.
Timeframe and Official Fee:
• 10 working days.
• Official Fee KHR 1 000 000 (approx. EUR 220).
