VIETNAM TAKES A STEP TOWARD REGULATING AI WITH NEW DRAFT LAW

The Ministry of Science and Technology of Vietnam has released the Draft Law on Artificial Intelligence (AI Law) for public consultation. The draft, comprising nine chapters and seventy articles, proposes a comprehensive and risk-based framework to govern the development, deployment, and regulation of AI in Vietnam.
The Draft AI Law sets out key elements of an AI governance framework, including definitions of AI and related concepts, foundational principles, risk classification and oversight mechanisms, prohibited AI practices, regulatory obligations, innovation incentives, enforcement measures, and penalties.
Notably, an official National AI Committee chaired by the Prime Minister will be established together with National AI Ethics Standards and AI Development Fund under the law. Moreover, the AI Law proposes that the act of copying and citing works, databases, legally for training purposes only for AI models, shall not constitute copyright and related rights infringement under certain conditions as specified by the law.
It is expected that the AI Law will be ratified and take effect on January 1, 2026, with a specific stage-by-stage timeframe for the implementation, including 6-12-18 months after the ratification of the AI law.
The introduction of the Draft AI Law marks an important step toward establishing Vietnam’s AI regulatory environment and reflects the government’s focus on fostering innovation while ensuring responsible technological development.
