In Kazakhstan, most of all counterfeit goods are imported directly from China or transit through Kyrgyzstan and Azerbaijan, and can also transit on the way to Russia and Europe.
One of the existing problems in the fight against counterfeit products is the lack of knowledge among law enforcement agencies on how to recognize counterfeit products from the original, outdated methodological approaches in the fight against trafficking in counterfeit goods, as well as insufficiently disclosed basic legal norms.
Why are counterfeit products so popular among consumers?
First of all, it is a low price. Rising prices are pushing consumers to choose the cheapest products that can be counterfeit and harmful to health. If there are negative consequences from such a product, then there will be no one to ask the consumer. Such goods are produced unknown and have not been officially imported into the country, respectively, the final manufacturer is unknown. For example, with tobacco and alcohol products, this can be doubly dangerous for health.
It is necessary to fight counterfeit products jointly by Customs authorities and copyright holders. Therefore, the copyright holder needs to enter his trademarks in the Kazakh Customs Register in order to protect not only his original products or goods, but also to protect consumers. The copyright holder can independently make decisions about who can import his products. There is a so-called "list of authorized importers", in which authorized representatives are entered by the copyright holder for the import and export of original products and carried out legal business activities.
