MAJOR PATENT REFORMS TOOK EFFECT IN MALAYSIA AT YEAR END 2025

On December 31, 2025, Malaysia will activate a post-grant patвцent opposition system following Notice No. 1/2025 issued by the Registrar of Patents. The amendments bring into force selected provisions of the Patents (Amendment) Act 2022 and related regulations, creating Malaysia’s first administrative procedure for challenging granted patents and utility innovation certificates.

Any interested party may file an opposition within six months of the grant’s publication in the IP Official Journal. Grounds include lack of novelty or inventive step, insufficient disclosure, omission of essential drawings, or non-patentable subject matter. Oppositions must be filed manually at MyIPO using the prescribed forms, with supporting evidence by statutory declaration. Non-resident opponents must provide security for costs. An independent committee may assist the Registrar in deciding whether to maintain, amend, or revoke the patent, with appeals available to the High Court.

Additional updates taking effect the same day include wider public access to patent documents, updated requirements for sequence listings in both PDF and WIPO ST.26 XML formats, and clarified procedures for PCT national phase entry and divisional applications. These changes represent a significant modernisation of Malaysia’s patent system, and rights holders may wish to review recently granted patents ahead of the new opposition window.
