Uzbekistan Introduces New Compensation Law for Intellectual Property Infringement

On September 10, 2024, Uzbekistan's President signed a significant amendment to the intellectual property legislation. This new law introduces a compensation procedure for IP rights infringement, marking a substantial shift in the country’s IP protection framework.

Under the amended Law on Inventions, Utility Models, and Industrial Designs, patent holders can now claim compensation from infringers, ranging from 20 to 1,000 Basic Calculated Values (BCV). One BCV equals 375,000 Uzbekistani som (approx. EUR 27.60). This compensation may be claimed irrespective of actual damages and will be assessed based on the nature of the infringement, the degree of guilt, and prevailing business practices. The amount of compensation shall be determined by mutual agreement between the parties or, failing such agreement, by a court decision.

Previously, Uzbekistan’s IP legislation did not include such compensation mechanisms. The introduction of these provisions is expected to significantly enhance IP protection by imposing stricter penalties on infringers. Additionally, the new law aligns Uzbekistan's IP protection practices with international standards.

The law will take effect three months after its official publication, providing time for all parties to adjust to the new regulations. This reform aims to ensure more effective intellectual property protection in Uzbekistan and strengthen the country’s position in the global market.
