Proposed Amendments to Strengthen Intellectual Property Protection in Uzbekistan

The Committee on Innovative Development and Information Technologies of the Legislative Chamber of Uzbekistan has initiated discussions on a draft law designed to strengthen intellectual property (IP) protection in the country. The proposed amendments seek to introduce more stringent penalties, including criminal liability, for violations related to copyright, related rights, and industrial property rights. These amendments would bring changes to the Criminal, Criminal Procedure, Administrative Liability, and Civil Codes, thereby reinforcing the enforcement of both personal non-property and property rights associated with intellectual property.
Under the current framework, Uzbekistan’s laws impose administrative penalties for various IP violations that typically result in fines and the potential confiscation of infringing goods. In cases of repeated violations within a year, penalties are increased, with fines ranging from UZS 11.25 million to UZS 18.75 million (approx. EUR 834 - EUR 1,398). The proposed amendments further address the unauthorized production, sale, and distribution of patented inventions and industrial designs. Fines for individuals involved in such violations would range from UZS 1.875 million to UZS 3.75 million (approx. EUR 139 - EUR 277), while fines for officials could range from UZS 3.75 million to UZS 7.5 million (approx. EUR 277 - EUR 554).
These proposed amendments aim to align Uzbekistan’s intellectual property laws with international best practices by introducing stronger legal provisions to combat IP infringements. Prior to advancing the bill for potential adoption, additional discussions and revisions will take place during meetings with political party factions.
