New Penalty for Late Patent Payments in Cambodia: Effective 15 October, 2024

Starting from October 15, 2024, Cambodia's Department of Industrial Property (DIP), under the Ministry of Industry, Science, Technology & Innovation (MISTI), will implement penalties for late patent annuity and restoration payments.

To prevent additional costs and ensure uninterrupted protection of your patent rights, review your patent portfolio to identify any payments due before October 15, 2024. Regularly check for incoming payment notices and address them promptly, ensuring that all payments are completed by their respective deadlines to avoid penalties imposed by MISTI.

If a payment is missed by the due date, there is a six-month grace period during which the payment can still be made, but with a daily surcharge of €0.11. If payment is not made within this grace period, the patent will be considered withdrawn or lapsed. However, the patent office offers a restoration option, requiring a €22.50 restoration fee plus an additional daily charge of €0.11 from the start of the grace period until the payment is completed.
