New Developments in Taiwan’s Design Patent System

The Taiwan Intellectual Property Office (TIPO) has introduced two initiatives to enhance the design patent application process. These developments include the launch of an online application platform and the extension of the Design Patent Accelerated Examination Pilot Program, reflecting TIPO’s commitment to supporting innovators and streamlining patent procedures.
The newly launched online system allows users to file design and derivative design patents, submit amendments, request reexaminations, and make annual fee payments —all through a web browser, eliminating the need for additional software.
TIPO has also extended the trial period for the Design Patent Accelerated Examination Pilot Program, enabling applicants to request expedited processing after receiving a preliminary examination notice. Applications must be submitted electronically with supporting documents, and no fee is required during the trial. Eligible cases include evidence of commercial use, design competition awards, or qualification as a start-up (with a limit of three applications per company per year).
Additionally, TIPO will adopt the latest International Patent Classification (IPC) edition (2025.01) starting February 5, 2025. The revised classification will be reflected in the Patent Gazette from March 11, 2025, and the Invention Publication Gazette from April 16, 2025.
