Article 1 of the Administrative Measures for Credit Evaluation of Patent Agents says that it is necessary to thoroughly implement the decision-making and deployment of the "Outline for Building an Intellectual Property Powerful Country (2021-2035)" issued by the Central Committee of the Communist Party of China, the State Council and the "14th Five-Year Plan for the Protection, strengthen patent agency hierarchy and classified credit supervision, promote patent agencies and attorneys in accordance with the law, and maintain the order of the patent agency industry.
Therefore, the State Intellectual Property Office is now in charge of the national patent agency credit evaluation management. The patent management departments of the People's governments of provinces, autonomous regions, and municipalities directly under the Central Government are responsible for the organization and implementation of credit evaluation work for patent agencies within their administrative regions.
The credit ratings of patent agencies and attorneys are divided into "A", "B", "C", and "D" grades in descending order, and evaluated according to the scoring situation. The full score is 100 points, which will be deducted according to negative information, which includes non-standard business or professional behaviour, abnormal operation of the institution, administrative or criminal punishment, industry punishment, etc. The grade standards are as follows:
(1) Grade A is a credit score above 90 (inclusive) and below 100 (inclusive)
(2) Grade B refers to those with a credit score of 80 points or more (including) but less than 90 points
(3) Grade C is a credit score of more than 60 points (including) but less than 80 points
(4) Grade D refers to those whose credit score is less than 60 points
Credit information collection, credit scoring, grade determination and result announcement of patent agency evaluation are carried out through the patent agency management system.
