VIETNAM’S NATIONAL ASSEMBLY PASSES MAJOR IP LAW REFORMS

On December 10, 2025, Vietnam’s National Assembly formally approved significant amendments to the Law on Intellectual Property, marking a substantial overhaul of the country’s IP framework. The revised law was adopted with a high degree of legislative support and is expected to take effect in April 2026, following detailed implementing regulations to be issued by the Government.
The amended legislation introduces a strategic shift in how intellectual property is treated within the Vietnamese economy by recognising patents, trademarks, copyrights, and related rights as commercial assets. Under the new regime, IP rights may be valued, transferred, pledged as collateral, and recorded in asset registries, providing enterprises with enhanced opportunities for financing and investment using their intangible assets.
In addition to assetisation, the law modernises procedural and enforcement mechanisms. It promotes full digitalisation of registration and examination processes, establishes clearer standards for handling AI-generated content and digital innovations, expands industrial design protection to non-physical products, and strengthens deterrent measures and judicial remedies for IP infringement. These reforms are designed to align Vietnam’s IP system with international best practices and support stronger commercialisation and protection of IP rights.
