Vietnam: Prime Minister Calls for Enhanced Enforcement Against IP Crime

On 30 January 2026, the Prime Minister issued Directive No. 02/CT-TTg on strengthening intellectual property (IP) enforcement, setting out key guiding principles for policy development and implementation. The Directive focuses specifically on IP, demonstrating the Government’s strong commitment to protecting IP rights in Vietnam and promoting the robust growth of IP assets.

The key provisions of the Directive include the following:

  • Intensification of criminal prosecution for IP violations and an increase in sanctions for IP offences under the Criminal Code.
  • The Ministry of Science and Technology is tasked with reviewing and proposing amendments to the IP Law and administrative enforcement regulations relating to industrial property rights.
  • The Ministry of Science and Technology, in coordination with the Ministry of Public Security and other relevant authorities, will establish an inter-agency National Database on IP Enforcement, incorporating AI and blockchain technologies to enhance IP protection.
  • The Ministry of Culture, Sports and Tourism is tasked with reviewing and proposing amendments to the IP Law and administrative enforcement regulations relating to industrial property rights, copyright, and related rights.
  • The Ministry of Public Security is responsible for reviewing and proposing amendments to the Criminal Code in relation to IP offences.
  • The Ministry of Industry and Trade, through the Market Surveillance Force, is tasked with inspecting and addressing IP infringements.
  • The Ministry of Finance, through the Customs authorities, is responsible for monitoring and handling IP infringements in connection with the export, import, and transit of goods.

The Prime Minister’s call for increased enforcement against IP crime reflects a proactive approach to safeguarding intellectual property in Vietnam. Through the implementation of these measures, the Government aims to foster a fair and competitive marketplace that encourages innovation and respects the rights of creators. This initiative represents a significant step towards strengthening Vietnam’s IP protection framework and enhancing the country’s economic development and global competitiveness.
