KAZAKHSTAN INTRODUCES REVISED TRADEMARK FEES AND CLASS-BASED CALCULATION RULES

Effective from January 1, 2026, updated rules on the calculation and payment of official fees for trademark registration have entered into force in the Republic of Kazakhstan. The changes follow the approval of new tariffs for services provided by the National Institute of Intellectual Property and apply to trademark filings, examination procedures, publication, issuance of protection documents, and other IP-related actions. The overall cost of procedures has also been affected by the increase in the VAT rate to 16%, up from 14%.

The most significant development concerns the method for calculating fees based on the list of goods and services. While trademark registration in Kazakhstan continues to operate under a multi-class system of the Nice Classification, each class is now assessed independently. From 2026, no more than 10 goods or services may be included per class without a surcharge. If this limit is exceeded, an additional official fee applies for each extra item within the same class, while other classes in the application remain unaffected.

As a result, the scope of goods and services declared in each class now has a direct impact on official fees, unlike under the previous rules. Applicants are therefore advised to carefully review and structure specifications when preparing trademark applications, particularly for multi-class filings.
