GEORGIA STRENGTHENS ONLINE COPYRIGHT PROTECTION

The Parliament of Georgia has approved amendments to the Law “On Copyright and Related Rights”, following a draft prepared by the National Intellectual Property Center, Sakpatenti. The changes are designed to modernise the legal framework for copyright protection, particularly in the digital environment, and to align Georgian law more closely with international standards.

For the first time, the statute introduces explicit provisions on the liability of intermediary service providers, establishing a formal notice-and-takedown mechanism for online copyright infringement. Under the new regime, rights holders can issue a written notice requesting the removal or restriction of access to infringing content hosted or transmitted by intermediaries, and intermediaries are obliged to act without undue delay.

The amendments also enhance the regulation of collective management of economic rights through state accreditation, clarify the distribution of royalties, and improve enforcement mechanisms. By updating procedural and substantive rules, the reforms aim to support the development of a lawful digital market, encourage creativity and innovation, and reinforce the foundations of Georgia’s intellectual property ecosystem.
