In June 2023, the China National Intellectual Property Administration announced, in the Notice of Application by Trademark Agencies, that it will no longer accept trademark applications from trademark agencies who have not registered with CNIPA, but these trademark agencies may complete existing applications.
Registered trademark agency practitioners can submit their registration, sign and bear legal responsibility; non-registered trademark agency practitioners cannot apply for trademark registrations.
For the trademark agencies that have not reapplied, the Trademark Office will mark them in the Trademark Online Service System and in the Trademark Agency System and will no longer accept the submitted trademark agency business application. If the trademark agency has no unfinished agency business, the Trademark Office will delete its record.
If the trademark agency wishes to continue operating, it should make a separate application for a new filing. It can go through the "Agency Filing Application" column of the Trademark Online Service System and select "Recorded Agency Filing". A trademark agency can apply after passing the new filing examination; if there is unfinished agency business when handling the new filing, it can continue to handle the original unfinished business after passing the new filing examination, and the original digital certificate will remain valid.
