New Fee Structure for International IP Applications in Thailand

On January 19, 2025, the Thai Department of Intellectual Property (DIP) issued an announcement. Starting February 1, 2025, the Thai Department of Intellectual Property (DIP) will implement adjustments to international application fees, international search fees, processing fees for international applications, and late payment fees. These changes aim to align international search fees with those set by international search authorities and reflect current exchange rates.

The revised fee structure includes updates to international application, search, and processing fees, as outlined in Schedule One of the official announcement. Additionally, applicants who fail to make timely payments will incur a surcharge of 50% of the overdue amount, in accordance with the applicable Ministerial Regulation. This surcharge applies solely to the basic international application fee and does not extend to additional charges for applications exceeding 30 pages.

Fee reductions will be available for applicants who are nationals or domiciled in countries listed in Schedule Two. In cases of multiple applicants, all parties must meet the nationality or domicile criteria to qualify for the reduction. Moreover, applicants designating the United States Patent and Trademark Office (USPTO) as the International Searching Authority may be eligible for a reduced search fee if they qualify as small or micro entities under U.S. federal regulations.
